1. Agreement to Terms
These Terms and Conditions ("Agreement") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("Parent," "Guardian," or "Student") and Danc'letics of Rochester ("Studio," "we," "us," or "our"), concerning your access to and use of our website as well as any other media form, mobile website or mobile application related, linked, or otherwise connected thereto, and your enrollment in any program, class, camp, workshop, or event offered by the Studio located at 1100 Long Pond Road, Suite 1-LL, Rochester, NY 14626. By enrolling or using our services, you acknowledge that you have read, understood, and agree to be bound by these terms in their entirety.
2. Enrollment & Registration
Registration is considered complete only upon receipt of a fully executed enrollment form, all required documentation, and any applicable registration fees. Enrollment is accepted on a first-come, first-served basis and is subject to class availability. The Studio reserves the right to deny or revoke enrollment at its sole discretion. A separate enrollment form is required for each student. All information provided must be accurate and current; you agree to notify the Studio promptly of any changes.
3. Tuition, Fees & Payment
Monthly tuition is due on or before the first (1st) day of each month. A late fee of $15 may be assessed on accounts not paid by the tenth (10th) of the month. Returned checks or failed electronic payments are subject to a $30 processing fee. All registration fees, costume fees, and recital fees are non-refundable. We accept cash, check, and major credit cards. The Studio reserves the right to adjust tuition rates with at least 30 days' written notice. Accounts more than 60 days past due may result in suspension from classes until the balance is paid in full.
4. Attendance, Absences & Withdrawals
Tuition is charged on a monthly basis regardless of attendance. There are no refunds, credits, or pro-rations for missed classes, holidays, snow days, or personal absences. We appreciate at least 48 hours' notice if you need to cancel or reschedule a private appointment. Make-up classes may be offered at the Studio's sole discretion and are not guaranteed. Withdrawal from any program requires written notice submitted at least thirty (30) days prior to the next billing cycle. Failure to provide written notice will result in continued billing. Non-attendance does not constitute withdrawal.
5. Studio Conduct & Dress Code
Students are expected to arrive on time, dressed in the appropriate dance attire as specified by their instructor. Hair must be secured away from the face. Street shoes are not permitted in dance studios. Parents, guardians, and visitors must remain in designated waiting areas and are not permitted to observe classes unless specifically invited. The Studio reserves the right to dismiss any student whose behavior, or whose parent's/guardian's behavior, disrupts the learning environment, without refund.
6. Health, Medical Disclosure & Assumption of Risk
Dance is a physically demanding activity that carries an inherent risk of injury. By enrolling, you voluntarily assume all risks associated with participation in dance classes, rehearsals, performances, and any Studio-related activities. You are required to disclose any medical conditions, allergies, physical limitations, or medications that may affect the student's ability to safely participate. The Studio is not responsible for monitoring individual health conditions. In the event of a medical emergency, you authorize Studio staff to seek emergency medical treatment for the student, and you agree to bear all costs associated with such treatment.
7. Liability Waiver & Indemnification
To the fullest extent permitted by law, you agree to release, waive, discharge, and hold harmless Danc'letics of Rochester, its owners, officers, instructors, employees, volunteers, and agents from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury (including death) sustained by the student during or as a result of participation in any Studio activities, whether caused by negligence or otherwise.
8. Photo, Video & Media Release
Unless the Studio receives written objection prior to the start of classes, you grant Danc'letics of Rochester a perpetual, royalty-free, worldwide license to photograph, video-record, and otherwise capture the student's likeness during classes, rehearsals, performances, and events. These materials may be used for promotional, educational, and marketing purposes. If you do not wish your student's image to be used, you must submit a written opt-out notice to the Studio before the first class.
9. Recitals & Performances
Participation in recitals and performances is encouraged but not mandatory. Students who choose to participate are responsible for the cost of costumes, recital fees, and any required accessories. Costume orders are placed in advance and are non-refundable once ordered. The Studio reserves the right to determine performance eligibility based on attendance and preparedness.
10. Force Majeure & Studio Closures
The Studio shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government orders, utility failures, severe weather, or other force majeure events. In such cases, the Studio may modify schedules, offer virtual classes, or provide make-up sessions at its discretion. No refunds will be issued for closures caused by force majeure events.
11. Personal Property
The Studio is not responsible for lost, stolen, or damaged personal property, including but not limited to clothing, shoes, electronics, jewelry, or bags. Students are encouraged to label personal items. Unclaimed lost-and-found items will be donated or discarded after 30 days.
12. SMS Communications & A2P 10DLC Compliance
Danc'letics of Rochester may use SMS (text messaging) to communicate with customers regarding class updates, appointment confirmations, service reminders, promotions, and customer support. By opting in, you can expect service communication and appointment confirmation messages for dance classes and studio events as needed.
You can cancel the SMS service at any time. Simply text "STOP" to opt-out. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you. Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.
We are committed to complying with the A2P 10DLC requirements, ensuring the security and privacy of mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Sharing mobile information with subcontractors who provide support services, such as customer service, is permitted. Text messaging originator opt-in data and consent will not be shared with any third parties under any other circumstances.
13. Eligibility and Age Requirement
By accessing or using this website and services provided by Danc'letics of Rochester, you confirm that you are at least 18 years of age or the legal age of majority in your jurisdiction. If you are under 18 years old, you may not use this website, submit personal information, or opt in to receive SMS communications without the consent and supervision of a parent or legal guardian. Danc'letics of Rochester reserves the right to restrict access to its services or terminate usage if we determine that a user does not meet the minimum age requirement.
14. Data Usage and Privacy
Mobile phone numbers collected for SMS communications are used solely for business-related communications from Danc'letics of Rochester. We do not sell, rent, or share SMS subscriber information with third parties for marketing purposes. We implement reasonable security measures to protect your personal information and prevent unauthorized access, disclosure, or misuse. 15. Dispute Resolution & Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to this Agreement shall first be addressed through good-faith negotiation. If the dispute cannot be resolved informally, the parties agree to submit to binding arbitration in Monroe County, New York, in accordance with the rules of the American Arbitration Association.
16. Entire Agreement & Modifications
This Agreement constitutes the entire agreement between you and the Studio regarding enrollment and participation. We may update these Terms and Conditions from time to time. Any changes will be posted on this page, and the updated policy will take effect immediately upon posting. Continued enrollment or participation after changes are posted constitutes acceptance of the revised terms.
